William
G. Gammon
Bill
is a founding member and managing partner of the law firm of William
G. Gammon and Associates, established in 1991, to exclusively represent
community associations of all types, both single family and multi-family
developments, as well as developers of real property. Gammon and
Associates is based in Houston, Texas with its practice area extending
to numerous counties within the State of Texas. Bill, and his firm,
is experienced in handling all aspects of real estate transactions,
litigation and property owner association representation. Bill provides
counsel and advice to the firm's clients including general community
association issues, warranty, contract, fair housing and litigation
matters. He has authored master deed restrictions for numerous large
residential and commercial developers and builders and has helped
draft proposed legislation beneficial to community associations.
Bill frequently testifies before legislative committees considering
laws that would impact the rights of community associations in the
State of Texas and has helped statewide coalitions of community
association attorneys to oppose suggested legislation which would
severely hamper a community association's ability to operate.
Bill
has been representing community associations for over 15 years and
has done extensive litigation and appellate work in the field. He
has litigated a large number of association deed restriction enforcement
cases including architectural, nuisance, corporate matters, construction,
design defect, contract as well as defamation. He has helped to
craft and clarify Texas law applicable to community associations
by successfully prosecuting many significant cases including reported
decisions such as Kingsbridge
Park Community Ass'n, Inc. v. Tien Tao, 953 S.W.2d 525 (Tex.App.--Houston
[1st Dist.] 1997, no writ). Over the years, Bill has regularly handled
contract and tort claims brought in behalf of a community association
to ensure that developers and independent contractors live up to
the expectations contracted for by his clients. In addition to representing
community associations in traditional litigation issues, he appears
in bankruptcy court on a regular basis to represent his client's
interest in bankruptcies filed by homeowners.
As
a result of his litigation expertise, Bill brings a solid understanding
and practical approach in counseling associations on complex, day
to day issues. His practice emphasizes the preventative aspects
of the operations of community associations. Bill believes that
a proactive approach to legal issues within community associations
is crucial to their success. He enjoys working closely with boards
to develop goals and implement policies which will ensure the financial
stability of their communities.
Bill
graduated with honors from the University of Texas where he received
his Bachelors Degree in Business in 1983. During his undergraduate
years, Bill was a very active member of Sigma Phi Epsilon fraternity,
the Texas Student Union, as well as a number of honorary scholastic
fraternities. His performance in the undergraduate business program
earned him an invitation into the honors business program offered
at the University of Texas. There he was able to earn credit toward
his Masters in Business Administration, a graduate degree which
he later obtained from the University of Houston, while at the same
time attending the University of Houston Law Center where he obtained
his doctorate of jurisprudence in 1986.
Bill
began his legal career with the law firm of Shrader & York, where
he practiced primarily in the areas of insurance defense, banking,
real estate and commercial litigation. He also has extensive experience
in bankruptcy and landlord/tenant litigation. Since 1989, Bill has
been practicing community association law and, in 1993, retooled
his law firm to focus exclusively on association representation.
Since that time, Bill has been quite active in drafting proposed
legislation beneficial to community associations and writing various
articles for legal trade journals including The
Houston Lawyer and The
Texas Bar Journal. Bill recently authored A
Foreclosure Too Far: An Introduction to the Texas Residential Property
Owner's Protection Act. [The Houston Lawyer, July/August
2002, Vol. 40, No.1, p. 18-25] In addition, Bill authors an internet
blog newsletter devoted solely to community association interests
entitled A View from the Property
Line.
Bill
has presented numerous legal seminars to both property management
companies as well as directors of associations. Bill works actively
with various national and regional trade associations such as the
Community Associations Institute ("CAI") as well as the Cypress
Creek United Civic Association ("CCUCA"). Bill sat as a director
for the Cypress Creek United Civic Association for over eight years
and conducted a monthly educational program geared to the numerous
community associations that comprise the CCUCA. Bill has also sat
as a board of director for the Greater Houston Preservation Alliance,
a non-profit corporation created to promote the preservation and
appreciation of Houston's architectural and cultural historic resources
through education and advocacy.
Bill
was licensed to practice law in all Texas State and federal courts
in 1986. He is currently licensed to practice before all Texas Courts,
the United States Court of Appeals for the Fifth Circuit, as well
as the United States District Courts for the Southern and Eastern
Districts of Texas. He is a member of the Houston Bar Association
and the American Bar Association. In addition, since 1994, Bill
has been trained and certified as a mediator through the American
Association of Arbitrators.
